The Service Roads on the HHGE
There are five service roads used by House Residents on the Estate for access to their garages. All are owned by HHGE Residents Ltd. a private limited company and managed by the HHGE (Houses) Residents Association. Over the years these service roads have become very neglected, as for historical reasons only a few house owners have either the legal right to use the roads or the legal obligation to pay for their maintenance.
Future Maintenance and Improvements to the Service Roads.
To ensure that future maintenance of the service roads is regularly carried out and that they are not allowed to deteriorate any further, HHGE Residents Ltd, through the HHGE (Houses) Residents Association, is insisting that, when a House is sold, the new owners enter into a Deed of Easement, granting them the right to use the service road to the rear of their property, in return for contributing a fair proportion of the cost of its upkeep and future repair.
Contribution to the Cost of Maintenance of the Service Roads
Each House owner with a garden and/or a garage, which backs onto a service road, will be expected to pay an equal proportion of the total cost of upkeep. For example if there are 20 garages on a particular service road they will be expected to pay 1/20th of the total cost. Before signing the Deed of Easement this contribution will be voluntary. After signing it the contribution will be compulsory.
The communal gardens on the Estate are also owned by HHGE Ltd. and managed by the HHGE (Houses) Residents Association. Currently the annual voluntary service charge contribution to their upkeep is £25 per house. After signing the Deed each owner would be legally obliged to pay 1/361st of the cost of maintenance and improvement.
House with no garage or gated access to a service road will not be expected to sign the Deed of Easement although they will still be expected to make a voluntary contribution to the upkeep of the communal gardens.
